Nish SHETTY, Partner

Nish SHETTY co-heads the India Practice and is a Partner in the Banking & Insolvency Practice.

His main practice areas are litigation and arbitration, corporate & shareholder disputes, insolvency, liquidation, receivership & judicial management, construction & civil engineering disputes and defamation and commercial fraud related matters.
 
Matters of significance which Nish has been involved in include acting for: ACCS, a Singapore-listed multinational company in relation to a corporate fraud investigation & subsequent restructuring ("ALB Award: Insolvency & Restructuring Deal of the Year 2007"); a group of major Asian airlines against a large multinational US computer company in an ICC arbitration conducted in London (before a tribunal comprising of three English QCs) involving multi-million dollar claims relating to breach of contract, fraud and conspiracy (in conjunction with lawyers from New York/Atlanta/Texas and a prominent English QC); a Singapore listed company against a European multinational company in an ICC arbitration in respect of engineering works carried out in SATS Changi Airport Terminal No 5; the Provisional Liquidators of PIPC (HK) in relation to a US$136 million Ponzi scheme involving Singapore, Philippines & Hong Kong; an international fund in relation to a multi-million dollar shareholder dispute and insolvency involving Singapore, China, Thailand and Mauritius; a listed Singapore construction company in relation to a multi-million dollar housing project in Whitefield, Bangalore, India; a leading Iranian manufacturing company in a US$40 million SIAC arbitration; an Indian company in an SIAC arbitration against a Korean chaebol; advising the Court-appointed Judicial Manager to Trans-United Corporation Ltd, Singapore's second biggest operator of private buses after ComfortBus; and a group of creditors in successfully opposing a Scheme of Arrangement proposed by Econ Corporation Limited, then Singapore's second largest construction company, with debts of S$256 million and subsequently acting for the Judicial Manager of Econ.

Nish is described as "one of the most promising insolvency specialists in Singapore - way beyond his years of experience" in Chambers Asia - Asia’s Leading Lawyers for Business 2008. He is also recognised for his work in the PLC Cross-border Restructuring and Insolvency Handbook 2008. He was identified as a "rising star" in dispute resolution in The Asia-Pacific Legal 500, 2004/2005. He is the South-East Asian Correspondent for the Global Arbitration Review and a member of the Editorial Board of the International Bar Association's Dispute Resolution International. He is also the Singapore Representative on Fraudnet, a division of the ICC Commercial Crime Services unit.

Nish is a member of Law Society's Arbitration and Dispute Resolution Committee and the Insolvency and Restructuring Committee. He speaks at local and regional seminars and conferences and contributes articles to leading publications on litigation, arbitration and construction law. He authored the Singapore Chapter of the Global Counsel Insolvency & Restructuring Handbook 2005/2006, and co-authored the Singapore Chapter of "The Asia-Pacific Restructuring & Insolvency Guide 2003/2004."  He is also a Member of the Society of Construction Law, Singapore. Nish was also a tutor in Building and Construction Law at the Law Faculty of the National University of Singapore (“NUS”).

Nish graduated from NUS and was admitted to the Singapore Bar. He was also admitted to the Roll of Solicitors of England and Wales.
